Statement of Ability for Employment Law

My experience covers the entire spectrum of employment law. Matters which I handle include wrongful termination, breach of contract, discrimination (race, gender, disability, age), harassment, retaliation, whistle-blowing, workers' compensation, disability, civil service, labor code violations, work-place safety, and actions under related federal laws including the False Claims Act, the WARN Act.

In my employment practice, I have appeared before numerous trial and appellate courts in Colorado, California, Texas, and the District of Columbia. I have represented clients before various agencies including the federal Merit Systems Protection Board, state and federal Equal Employment agencies, and the U.S. Postal Service.

Brever v. Rockwell Int'l Corp., et al., 40 F.3d 1119 (10th Cir. 1994) - Subject: Retaliation against employees who testify in federal court;

Headrick, et al. v. Rockwell Int'l Corp., 24 F.3d 1272 (10th Cir. 1994) - Subject: Class action under federal WARN Act and state wage laws arising from layoffs;

United States v. Rockwell Int'l Corp., 124 F.3d 1194 (10th Cir. 1997) - Subject: Government intervention in False Claims Act action brought by whistle-blower;

United States ex rel. James S. Stone v. Rockwell Int'l Corp., 173 F.3d 757 (10th Cir. 1999) - Subject: Release of grand jury testimony for use in False Claims Act action brought by whistle-blower.

United States ex rel. James S. Stone v. Rockwell Int'l Corp., 265 F.3d 1157 (10th Cir. 2001) - Subject: Affirmed jury verdict against contractor at Rocky Flats Nuclear Weapons Plant in False Claims Act action brought by whistle-blower.

Monreal v. Potter, Postmaster General, 367 F.3d 1224 (10th Cir. 2004) - Subject: Federal employees' administrative exhaustion of individual discrimination claims through administrative class complaint, class certification.


I have successfully settled or tried cases with major employers including Lockheed Missiles and Space Corp., Federal Express Corporation, the University of California, the U.S. Postal Service, Rockwell International Corp., and EG&G Rocky Flats.

My representation of workers at the Rocky Flats Nuclear Weapons Plant near Golden, Colorado, was featured in "The American Lawyer". I am a presenter in an educational video series concerning whistle-blowers in employment situations. I have produced and edited video presentations for several employment cases.

Prior to attending law school, I held a wide variety of positions, union and non-union, covering some fifteen years. My jobs included hospital worker, factory worker, public school teacher, construction worker, and design engineer. I have a down-to-earth knowledge of the work-place and what goes on there.

While the majority of my clients have been employees, I am also open to and knowledgeable to the concerns of the employer. I have represented employers, including major engineering firms, in defending wrongfuldischarge claims, handling the discipline and termination of employees, defending charges before state regulatory agencies, and drafting human relations manuals and policies. I am an employer and a business owner.

In mediation, I bring a balanced neutral view. I will do all I can to obtain the result for which you came to mediation - a fair settlement.
