Statement of Ability for Construction Law

In mediation, my education and experience in construction are especially valuable because they allow me to fairly and accurately understand the positions - including technical issues - of all parties.

I have the full range of experience in construction, from "hands on" in the field as a journeyman sheet metal worker, (and an apprentice ironworker who worked "high steel"), to design of mechanical HVAC systems, to litigation of complex claims. Combined with my technical education (B.S. Mechanical Engineering, University of Colorado), my experience enables me to do what most attorneys cannot - visualize and fully conceptualize any situation that may arise in the design and construction of nearly any project.

I am familiar with construction techniques commonly employed on large and small projects, and the attendant safety issues. I know the forms of contracts used - for either design or actual construction - and how they are administered.

I am especially effective with issues respecting contractors' means and methods, alleged design errors or omissions, critical path analysis, and impact claims.

I can reduce and, in some case eliminate, the need to utilize expensive expert presentations. This is because I am conversant with the primary design disciplines, as well as the standard construction trades and their work. I can reach the most obscure and detailed points involving issues like specification writing, or shop drawing preparation and review. I can spot the critical issue among the sea of data that characterizes construction disputes.

I readily understand the concerns of the owner, the design professional, the contractor, and the individual construction worker. I want to be the catalyst for an early and cost-saving resolution that benefits all concerned.
