ADR includes mediation, negotiation, settlement, and arbitration by which parties to a dispute seek resolution of their differences without the excessive cost of protracted litigation through the courts. ADR also includes the early resolution of cases already in court at a fraction of the cost of a trial.
ADR provides a unique opportunity for the parties to exercise control over the outcome of their dispute. When a dispute is resolved by a court, one party must lose. Sometimes courts render decisions which cause both
parties to believe they have lost. When a resolution is reached through ADR it is one which all parties have fashioned and agreed upon - not one imposed on them.
Because of the potential benefits, which are substantial, all cases and controversies should be carefully considered as candidates for ADR - considered early on before the client's money is spent on litigation. Even a mediation that does not result in settlement can be beneficial. It can help the parties to understand the true strengths and weaknesses of their position - a necessary foundation for a later settlement.
